У дисертації на підставі аналізу наукової літератури та архівних матеріалів досліджено правову природу, історію становлення, розвитку і поширення хелмінського (кульменського) права на території Центрально-Східної Європи, Пруссії (теперішні ФРН, Польща та Російська Федерація), Польщі та України. Встановлено і проаналізовано структуру органів. В диссертации на основе анализа научной литературы и архивных материалов исследовано правовую природу, историю становления, развития и распространения хелминского (кульменского) права на территории Центрально-Восточной Европы, Пруссии (нынешние ФРГ, Польша и Российская Федерация), Польши и Украины. Установлено и проанализировано структуру органов самоуправления городов, основанных на хелминском праве, на примере города Торунь. Проанализированы источники хелминского права и их кодификации (ревизии). Выяснена роль хелминского права в кодификации украинского пра¬ва в XVІII – первой половине XIX в. самоврядування міст, заснованих на хелмінському праві, на прикладі міста Торунь. Розкрито дже¬рела хелмінського права та їх кодифікацію (ревізії). З’ясовано роль хел¬мін¬ського права в кодифікації українського права у XVІII – першій половині XIX ст. On the basis of analysis of scientific literature and archival materials the legal nature, the history of formation, development and spreading of Khelmno (Kulm) law in Central and Eastern Europe, Prussia (nowadays Germany, Poland and Russia) Poland and Ukraine are investigated. Khelmno (Kulm) law along with neumark law is a kind of Magdebourg law. It emerged in Prussia in the State of the Teutonic order and spread to neighbouring lands of Poland, Lithuania and Ukraine. The order state system needed legal registration that stipulated the emergence of Kulm law based on more ancient Magdebourg law. Kulm law, in turn, became a legal instrument in the process of colonization of the Prussian lands. The basis of Kulm law was a privilege that was given out by the Grand Master of the Teutonic order Hermann von Salza and landmeister of Prussia Herman von Balk on 28 December 1233, which became known as Khelmno (Kulm) charter. Historical connection between the processes of reception of the Roman law and the development of Khelmno (Kulm) law is found, the mutual influence of recipient and municipal law is proved, the mechanism of transformation of many recipient terms and callings through research of language of normative sources – monuments of Khelmno (Kulm) law is stated. The role of Khelmno (Kulm) law in forming some principles of municipal law, in particular to the interconditionality of rights and duties of the middle class, equality of rights of municipal citizens, electiveness of city authority, judicial jurisdiction of city, legal defense of city in relationship with the state, state power, other cities is found out. The structure of organs of self-government of the cities based on Khelmno law is determined and analysed on the example of the city Torun. The sources of Khelmno law and their codification (revisions) are analysed. The role of Khelmno law in the codification of Ukrainian law of XVIII – first half of XIX century is found out. The chronologic limits of research embrace XIIІ – first half of XIX century. The lower chronological limit is dictated by the fact that on December 28, 1233 the Teutonic order issued the first locating privilege for cities Torun and Chelmno, called Khelmno (Kulm) charter. Distribution and codification of Khelmno law lasted during XIII – XVI century. The upper chronological limit of the research is proved by the fact that in 1807 «Zibrannya malorosiyskich prav» was published for which Kulm law was the main source. The results of dissertation can be used in the following areas: in the research area the basic statements and conclusions of the thesis can be used for further historical and legal researches of Khelmno (Kulm) law, for writing encyclopedia articles; in education process the main statements and conclusions of the thesis can be used in teaching courses of history of state and law of Ukraine, History of State and Law of foreign countries, state law of foreign countries. In the area of law the research results can be applied in the work of executive bodies and local authorities; in the law educational area the use of materials of dissertation will assist the increase of level of awareness of the population about the historical past. |
