The article defines the legal aspects of the air transport of pregnant women having children on board the aircraft and especially the definition of citizenship. The author makes a conclusion that the national legislation contains gaps and conflicts with respect to international legislation regulating these issues. English abstract L. Theauthormakes a conclusionthatthenationallegislationcontainsgapsandconflictswithrespecttointernationallegislationregulatingtheseissues. There are manyairlines, inparticular, AirFrance, Lufthansa, UnitedAirlines, Delta, Alitalia, Swissair, donotletonboardwomen, gestationalageexceeds 36 weeks. Practiceshowsthatnoreservationcannotguaranteeabsolutesecurityforchildbirth, because I thinkthoseairlinesthatcarryfreightpregnantwomen, exceptwithhelpfrom a doctor, requirepriornotificationaboutspecialneedspassengers. Whenthecarrierdiscoversthatcarrythepregnantpassengerflight, theairlinecarriermustensurethatthecrewneededmedicinesandsanitaryequipmentnecessaryincaseofbirth. Formedicalassistanceduringchildbirthduringgroundtransportation, theMinistryofHealthofUkrainedeveloped a procedurefortransportingpregnantwomeninUkraine. I thinkthatatleastpartofthelistofessentialtoolsshouldbeincludedandtheRulesofairtransportationofpassengersandbaggageandprovidethemeveryairportandeverycabinoftheaircrafttobeabletoassistinchildbirth. Also, weseethatinthecourseofthecontractforthecarriageofpassengerswithdisabilitiesbyair, thereis a complexsetofservicedeliverynotonlyintransportationbutalsoprovidethenecessarymedicalcare. Giventheresponsibilitythatthecarrierislifeforpassengers, airlinesshouldnotbelimitedtotheprohibitivemeasuresofprotection, butalsotocoordinatelegislationtoimprovetheefficiencyofmedicalservices, includingpregnantwomen.
У статті визначаються правові аспекти повітряного транспортування вагітних, народження дітей на борту повітряного судна та особливості визначення їх громадянства. Автор робить висновок, відповідно до якого національне законодавство містить прогалини та неузгодженості з міжнародним законодавством у регулюванні зазначених питань. |
