У статті розглядаються джерела латинської юридичної термінології, її становлення та подальший розвиток. Показано генезис латинської юридичної термінології та її тісний зв’язок з витоками та історією римського права. Досліджено перші юридичні документи та праці юристів класичного періоду (Емілія Папініана, Юлія Павла, Доміція Ульпіана та ін.), які є основними джерелами виникнення правничої термінології. (The article investigates the sources of latin juridical terminology, its becoming and the further development. Genesis of latin juridical terminology is closely connected with the sources and history of the Roman law. The first legal documents and labours of classical lawyers (Papinian, Paul, Ulpian and others) are the basic sources of origin of legal terminology and legal constructions, which deservedly became basis of general European legal doctrine. Special attention is given to «The Laws of the Twelve Tables», edicts of magistrates and emperors’ constitutions. The labours of famous Roman historians (Tit Livy, G. Suetoni Tranquil) are also characterized as their works had great influence on the formation of latin legal terminology.) |
