Description There are given grounds to the thesis that the main obstacle to achieving sustainable devel­opment under modern conditions is the lack of objective cost estimate of the natural resources involved in the production and consumption. It is shown that unestimated production factors can be used indefinitely, which in reference to natural resources will lead to natural resources exhaus­tion. The article considers overcoming this obsta­cle from the perspective of establishing the prop­erty rights on natural resources.
It has been found out that within choosing the natural resources' ownership form in econom­ic activities in order to prevent or reduce the nega­tive influence of environmental pollution on eco­nomic processes it is possible to form different mechanisms of economic loss compensation from pollution. The order of selection is shown by the example of the following mechanisms - equal sharing of losses among the members of society and distribution according to efforts made by business entities in the resumption of the natural balance and sustainable development.
Four institutional models to form the property rights on natural resources have been pro­posed: the lack of property rights, passive, active and integrated rights of ownership. It is shown that in the absence of property rights on natural resources' regulation becomes complicated be­cause of their excessive consumption excluding the rate of natural reproduction. The passivity of property rights is proposed to be considered from the point of getting benefits' flow from exploiting natural resources without investing into nature protection measures. Active ownership of natural resources lets the owner get access to this re­source, rent from its use, exclude other individual from the process of resources usage, sharing and modification (in some cases destruction) within the law. Integrated ownership is proposed to be considered on the basis of getting benefits from using all resources, not just the part that is used to produce a single product or to meet a specific need. The condition of using integrated property rights, in which all users of natural resources guarantee that the amount of consumption will not exceed the reproductive properties of nature, has been formulated.
Розглянуто проблеми встановлення прав власності на природні ресурси в забезпе­ченні сталого розвитку. Запропоновано поділ прав власності на природні ресурси на чотири групи: відсутність прав власності, пасивні, активні та інтегровані права власності. Показано умови забезпечення сталого розвитку залежно від вибраної інституціональної моделі прав власності.
