The article presents a comparative analysis of the liability of legal persons for the creation of criminal associations and participation in them under the laws of Ukraine and other countries. Proposals concerning improvement of Ukrainian legislation in this sphere.English abstractThearticlepresents a comparativeanalysisoftheliabilityoflegalpersonsforthecreationofcriminalassociationsandparticipationinthemunderthelawsofUkraineandothercountries. Itwasestablishedthattodaywehave a defactomechanismforliabilityoflegalpersonsinthecaseofcertaincrimeswhicharenotdejurecriminalliability. Itistosomeextenthelpstopreventcrimescommittedintheinterestsoflegalentitiesandhasthepotentialtobecomeanintegralelementofdamagescausedbythecrime.Proposedextendin CC Ukrainegroundsapplicationtothelegalentitiesmeasures of criminallawcasesbycrimeunderArt. 255 and 257 oftheCriminalCodeofUkraine. Inthisregard, p. 4 h. 1 art. 96-3 CC Ukraineofferafterwords "Article 160," tosupplementthenumbers "255, 257".Proveninexpediencetolimitquasicriminalliabilityoflegalpersonscommittingthecrimeforthebenefitof a legalperson,ifitledobtainingunlawfulbenefitorcreatedtheconditionsforsuchbenefitsorpurportedtoavoidancethestatutoryresponsibilitiesinappropriatetobecauseintheinterestsoflegalentitiescanbecommittedcrimesinvolvingnotonlyunlawfulprofits,forexample, tothephysicaldestructionofvictims. Definitelyobtainingunlawfulbenefitthemostcommon, butnottheonlypurposeofcommittingcrimesforthebenefitof a legalperson.Donotlimitotherpossibleoptionsandavoidancethestatutoryresponsibilities. В статье осуществлен сравнительный анализ ответственности юридических лиц за создание преступных объединений и участие в них по законодательству Украины и других стран. Разработаны предложения относительно усовершенствования украинского законодательства в этой сфере У статті здійснено порівняльний аналіз відповідальності юридичних осіб за створення злочинних об’єднань та участь в них за законодавством України та інших країн. Розроблено пропозиції щодо удосконалення українського законодавства у цій сфері. |
