Description У статті досліджено законопроекти, що знаходяться на розгляді у Верховній Раді України і пов’язані із запровадженням накопичувальної складової загальнообов’язкового державного пенсійного страхування. Визначено основні переваги та
недоліки законопроектів. Зроблено висновки щодо необхідності введення другого рівня пенсійної системи.
(Pension reform is one of the most important and complicated reforms of the present time in Ukraine. The unresolved pension problems generated by the complex interdependent socio-economic and demographic processes cardinally influence public opinion, financial and economic spheres and may lead to a collapse of the state fi nance system. Pension reform is a radical change in the essence of the provision of pension system, the transition to a model of a system based on accumulative principles of fi nancing, that is, based on individual pension accounts. Thus, in Ukraine since January 1, 2004, the pension system has transformed into a three-level system dejure, although today it remains de facto two-level system: the reformed solidary system (first level) and non-state pension provision (third level of the system). Therefore, since 2006 the legislative process on introducing of an obligatory level of the accumulation system has become highly active in Ukraine. 13 bills were proposed for consideration by the Verkhovna Rada of Ukraine since 2006 to 2017 regarding the introduction of a accumulative system of compulsory for all state pension insurance, most statements of which contain identical approaches to the mechanism of introduction of the accumulation component, regulation of relations in this area, however, differ in several conceptual principles, each of which can significantly affect its functioning. One of the conceptual differences in the bills is the rejection of the centralized model of the accumulation system for the accumulation of second level insurance contributions through the creation of the Accumulation Pension Fund and the transition to a decentralized model through non-state pension funds. The analysis showed that the mixed model proposed by the Bill No.2854 "About the introduction of the accumulation system of obligatory state pension insurance", submitted by the Cabinet of Ministers of Ukraine, in the best way suits the requirements - the simplicity and the availability of regulatory framework for understanding and acceptance by all parties of the process; the organized mechanism of the administrative system for the rapid registration of the entire range of insured persons; the ability of the institutional infrastructure to process and systematize a
large data of information; ensuring of control over the receipt of insurance fees. At the same time, the lack of state guarantees for the preservation of pension funds and the mechanism of their protection against infl ation, the ambiguity of the interpretation of certain statements of the legislative framework, the non-regulation of gender questions can prevent it from effective functioning.)
