One of the issues "justice" analyzed in the philosophy of law and these theme is the basis of jurisprudence. The justice, as one of the most important properties of morality and also reflects its superior attributes. According to the philosophers, the concept of justice is divided into several categories and development of these categories based right and laws. The study have been analyzed of ancient Greek thinkers in outlook and subsequently the thoughts of justice and it was concluded at that time, justice in relation to a person the attributes of its superior, it was adopted as the basis of respecting the right of others. Однією з тем філософії права є проблема «справедливості», яка становить основу цієї дисципліни. Принцип справедливості є також однією з головних відмінних рис моралі і підкреслює її особливості. На думку філософів, поняття справедливості ділиться на кілька категорій, і їх використання засноване на праві та його основоположних законах. Принцип справедливості пов’язаний з правовими принципами, справедливість, що не грунтується на законах, залишається лише на рівні слів. У даній статті, поряд із посиланнями на теорії філософів і правознавців, проаналізовані суспільні сторони поняття справедливості, а також досліджена її юридична суть. Одной из тем философии права является проблема «справедливости», которая составляет основу этой дисциплины. Принцип справедливости является также одной из главных отличительных черт морали и подчеркивает ее особенности. По мнению философов, понятие справедливости делится на несколько категорий, и их использование основано на праве и его основополагающих законах. Принцип справедливости связан с правовыми принципами, справедливость, не основывающаяся на законах, остается только на уровне простых слов. В данной статье, наряду со ссылками на теории философов и правоведов, проанализированы общественные стороны понятия справедливости, а также исследованы ее юридические смыслы. |
