Досліджено предмет галузі в системному взаємозв’язку конституційного і муніципального права. На підставі поєднання двох внутрішньо протилежних складових предмета (публічне і приватне) і методу (субординації та координації), що створює особливий режим муніципально-правового регулювання, автор визначає ціннісно- смисловий зміст муніципального права України, його базові галузеві ознаки, місце і значення в правовому механізмі. On the pages of this article was examined a subject of the branch of law in system communications of constitutional and municipal law. The author defines the value and semantic contents of the municipal law, its base attributes as legal branch, and it’s place and value in a legal mechanism of regulation local public relations. The author notices the main conditions of formation of the municipal legislation and law as adoption of a basic functional law in the economic, social or spiritual sphere of local social relations. The methodological approach to the study of legal phenomena provides an opportunity to justify the conclusion about the recognition status of municipal law as branch of national law system. Researching theoretical and methodological aspects and the justification of systemic-technological analysis approach of municipal legalphenomena and its processes, will allow implementing a constructive function theory of constitutional law. Municipal law uses mathematical and statistical methods in resolving problems that presents now in the legislative and law enforcement practice. Municipal legal regulation is functional part of constitutional and legalizes public relations regulation process and has all the basics of complex institutional system. It combines a large number of elements that are giving differences for both internal (between own legal elements) and external links (inter legal system), in comparison to other elements of society in economical, political and cultural spheres. The researching object in the science of municipal law is the reality of local government as a whole (as a system phenomenon) and as its institutions. Municipal law science differs from the others, by its need, to be forecasted, managed and has prospective impact on its objects of regulation. The subject of scientific knowledge is fragments or aspects of reality, that are defined by separated aims and objectives of researching. It has branched predetermined level of specific conceptual and categorical apparatus of methodological means and methods specified knowledge. In this sense, particularly, is important understanding of the dual nature of the subject of science municipal law. Subject of the law determines by social and historical factors and displays the real state of local public relations in the country, which in they turn are governed by norms of constitutional and municipal law. The subject of municipal law defined as public relations connected with the organization and functioning from local self-government (or selfgovernance) as relatively independent and separated public local authorities in the democracy system within certain administrative-territorial units. Municipal law is a structural element of Ukrainian national law and regulates mixed groups social relationships that are separated geographically by the self-governing basis. |
