У статті досліджується проблема спроби створення судових органів для розгляду справ пов’язаних із відповідальністю громадян УНР, які були державними службовцями, в евакуації у місті Тарнів (Тарнув) у Польщі в липні-серпні 1920 р. В цей час українські державні інституції в результаті наступу Червоної армії на території України були вимушені евакуюватися до Польщі і розмістилися у місті Тарнів. Міністерство внутрішніх справ УНР висунуло ініціативу створення у цьому місті судових органів у яких би розглядалися справи щодо службовців державних інституцій УНР. Таким чином виникала можливість забезпечити функціональність й ефективність роботи урядових інституцій УНР в умовах їх перебування на території за межами України. Ця ініціатива перебувала на розгляді у Міністерства юстиції УНР, котре передало її на розгляд до Міністерства закордонних справ, зважаючи на необхідність вияснення питання щодо статусу евакуйованих до Польщі громадян УНР. Дане питання мало важливе значення зважаючи й складність розгляду та вирішення зважаючи як на зовнішні чинники так і на внутрішню адміністративно-правову ситуацію в Польщі. Система польського законодавства і судочинства, зокрема, перебувала на цей час лише у стадії формування. Також, важливу роль відігравав для УНР фактор початку переговорів між Польщею та РСФРР і УСРР щодо укладення перемир’я у радянсько-польській війні 1920 р. Тому проблема створення окремого суду для державних службовців урядових інституцій УНР мала важливе значення у збереженні їх функціональності й легітимності.
The problem of the creation of the legal institutions for the consideration of legal cases related to the responsibility of citizens of Ukrainian People's Republic, who were the civil servants at the time of Tarniv evacuation in Poland in July-August 1920 has been studied in the current article. At the same period of time Ukrainian national institutions had to evacuate to Poland because of the attack of the Red Army and were located in Tarniv. The Ministry of Internal Affairs of Ukrainian People's Republic has put forward the initiative to create the judicial bodies, in which the cases related to the employees of the state institutions of Ukrainian People's Republic would be considered. Thus, there has appeared the possibility to ensure the functionality and performance of the work of the governmental institutions of Ukrainian People's Republic in the conditions at the time of their residence on the territory of Ukraine and outside of it. This initiative was under consideration by the Ministry of Justice of the Ukrainian People's Republic which submitted it for consideration to the Ministry of Foreign Affairs, taking into account the need to clarify the issue of the status of evacuees to Poland of Ukrainian People's Republic citizens. This question had an important impact taking into consideration the difficulty of the investigation and the decision making, considering the external factors and the internal legal-administrative system in Poland. The system of Polish law and justice, in particular, was at that time only at the stage of formation. Moreover, a particular role in the negotiations between Poland and Russian Socialist Federation Soviet Republic and Ukrainian Socialist Soviet Republic had the case of making truce in the Soviet-Polish war of 1920. Thus, the problem of the creating of a separate court for the state workers at the state institutions of Ukrainian People's Republic had a very important meaning for the preserving of their functionality and legitimacy. |
