The article deals with the actual problems of modern constitutional reform in terms of temporal features of the current Constitution of Ukraine and the consideration of the existing constitutional initiatives. The author emphasizes on the necessity of the following of the constitutional procedure requirements for amending the Constitution of Ukraine as a condition of its stability and raises questions about the need for improvement of such procedure. The author focuses the analysis on two main aspects of the current constitutional process: “restoration” of the Constitution of Ukraine and temporal issues of the newest drafts of constitutional amendments. Taking into account historical experience of the amendments of the Constitution of Ukraine and even its dramatic effects the author stands for the formal legitimation of the constitutional framework following the adoption in February 2014 decision to return to the Constitution of Ukraine amended by the Law № 2222-IV (because the current way of being returned by the ordinary law seems to be problematic from the legal constitutional process. The article also affects procedural risks related two drafts law of the constitutional amendments – on decentralization of power (reg. № 2217) and on justice (reg. № 3524). In conclusions the author says, that the current constitutional reform requires a thorough rethinking, including the attitude to the prescribed constitutional procedures, and necessity of its clarifying and improvement. It seems to be real way to the rule of law because the сhosen (opposite) way negatively affects the level of legal culture in the country, causing vicious circle of lack of respect of the Constitution. У статті досліджено актуальні проблеми сучасної конституційної реформи в Україні в аспекті аналізу темпоральних особливостей чинної Конституції України та порядку розгляду існуючих конституційних ініціатив. Автор звертає увагу на необхідність дотримання процедури внесення змін до Конституції України як умови її стабільності й порушує питання щодо необхідності вдосконалення такої процедури. |
