The article reveals the problems of institutional innovations in public service in the light of the latest legislation. The attention is focused on the theoretical and legal analysis of the provisions of the new Law of Ukraine “On civil service”. The paper outlines the system of institutional framework for the organization and management of public service joining the civil service, the legal status of a civil servant working conditions, termination of public service. The author highlights expansion mechanisms and disciplinary liability of civil servants; emphasizes the trends of narrowing the scope of the civil service, lack of transparency, openness and publicity, the trends of improvement of the civil service. In view of the above, the major institutional innovations of public service, including a new Law of Ukraine “On civil service”, are as follow: 1) introducing the principles of public service and narrowing the scope of the existing public service (e.g. Patronage Service, etc.); 2) outlining the legal regulation of the civil service and the admissibility of the existence of an extensive system of law; 3) outlining the general requirements for public officials and the general system of rights and responsibilities; 4) implementation of existing rules on working time and rest periods; 5) clarification of the rules on remuneration, taking into account the possibility of payment by donor funds; 6) highlighting the lack of adequate mechanisms to prevent and combat corruption offense; 7) highlighting the lack of mechanisms to ensure transparency, openness and accessibility of public services; 8) emphasizing the deepening and expanding mechanisms of a disciplinary liability and civil servants; 9) restriction of social security for civil servants on social protection, including pensions; 10) determination of grounds for termination public service; 11) the absence of public control. Bearing this in mind, the main trends of improvement of the civil service are the following: 1) identification of goals, objectives, and strategies of civil service reform; 2) systematization of legislation on civil service on the basis of a single codified law, taking into account international and European standards, the position of civil society, experts, scientists, researchers, 3) ensuring the quality of public service institutions through interaction of society and the state; 4) ensuring the completeness of the legal status of a civil servant at all stages of the civil service, including: rights, obligations, guarantees, and restrictions; 5) ensuring the quality of motivation of civil servants, promotion of a professional career; 6) ensuring legal and social protection of civil servants; 7) publicity, openness and transparency in public service; 8) strengthening public control over civil service. У статті досліджено проблеми інституційних новацій державної служби через призму новітнього законодавства. Акцентовано увагу на теоретико-правовому аналізі положень нової редакції Закону України «Про державну службу». Охарактеризовано систему інституційних засад з питань організації та управління державною службою, вступу на державну службу, правового статусу державного службовця, умов праці, припинення державної служби. Підкреслено розширення механізмів дисциплінарної та матеріальної відповідальності державних службовців. Наголошено на тенденції щодо звуження сфери державної служби, недостатності прозорості, відкритості, публічності. Визначено тенденції удосконалення інституту державної служби. |
