У статті досліджено проблему надання правових підстав для функціонування Православної церкви в Польщі після закінчення Другої світової війни і до 2015 р. Проаналізовано законодавчі акти, що регулювали діяльність релігійної організації в період існування Польської Народної Республіки. Розглянуто основні моменти узгодження та колізії юридичних норм Канонічного та Конституційного права в зазначений період. (In the article investigated the problem of providing a legal basis for the functioning of the Orthodox Church in Poland after the Second World War to 2015. Legislation governing the activities of religious organizations in the period of the Polish People’s Republic is analyzed in the article. Also in this research we have been considering the main points of conflict and harmonization of legal norms of the Canon and the Constitutional Law in this period. After the Second World War there have been changes in the Polish public and political life. The Orthodox Church was forced to adapt to such circumstances. Simultaneously, it suffered serious losses. The new state demarcation impact on church-territorial structure and shuttle population also influenced the geography confession. Head of Church authority has been undermined and this affected the internal structure and priorities of the external actions.) |
