Abstract	In the wake of legislative changes that occur in Kosovo drafting of the penal code was the part of it where its implementation started on January 1st, 2013. Without having to emphasize the importance of this code the attention should be in its own content. The new Penal Code contains a number of new solutions and that is quite natural having in mind circumstances under which the old code was released. But what are the parts of the new penal code that need to be re-evaluated and reassessed in order to have satisfactory results and where a need to change some titles and chapters is necessary. One of the issues that can be debated comes from the previous decade when the code was adopted. There was a lack of laws in penal spheres and that is in general what the characteristic is. In other words the change that occurred was the change in naming the penal code but not in structure and it did not qualify to be named as a code. Therefore, the entire process of codification is impossible to be done when under protectorate, because the entire stability of the country’s system and the society is adamant where the final product is a code and its successful implementation.
