Мета: у статті розкриваються питання щодо визначення видів правотворчості Президента України. Методи дослідження: за допомогою наукових праць вчених виділено особливості правотворчості глави держави. Результати: подано класифікацію правотворчості глави держави, з’ясовано основні елементи правотворчості Президента України, подано класифікацію актів правотворчості Президента України, визначено напрями для подальшого дослідження обраної теми. Обговорення: необхідність зміни законодавства України щодо досліджуваної сфери.
Purpose: the article reveals the issues of determining the types of law-making of the President of Ukraine. Methods of research: with the help of scientific papers of scientists, the features of the law-making of the head of state are highlighted. Results: the classification of the lawmaking of the head of state is given, the main elements of the law-making of the President of Ukraine are determined, the classification of acts of law-making of the President of Ukraine is presented, directions for further study of the chosen topic are specified. Discussion: the need to change the legislation of Ukraine regarding the investigated sphere. The article reveals the issues of determining the types of law-making of the President of Ukraine. With the help of scientific works of scientists, the features of the law-making of the head of state are singled out. The classification of the lawmaking of the head of state is presented, the main elements of the law-making of the President of Ukraine are elucidated, the classification of acts of law-making of the President of Ukraine is presented, directions are given for further study of the chosen topic. The necessity of changing the legislation of Ukraine concerning the investigated sphere is emphasized. The law-making of the President of Ukraine includes: 1) the issuing of decrees, orders and other acts; 2) implementation of the right of legislative initiative; 3) the right to veto laws; 4) the signing of international treaties. The main features of the lawmaking of the head of state: 1) the final result is the adoption of a legal act; 2) the ability to influence the law-making of other bodies; 3) close connection with the powers of the head of state; 4) uninstalled number of applications; 5) independent character (except for cases of contraction); 6) the procedure for issuing acts is established. And, finally, it should be noted that some of the law-making acts of the head of state are the source of administrative law, since they relate to the administration of the state. Цель: в статье раскрываются вопросы определения видов правотворчества Президента Украины. Методы исследования: с помощью научных трудов ученых выделены особенности правотворчества главы государства. Результаты: представлена классификация правотворчества главы государства, выяснены основные элементы правотворчества Президента Украины, представлена классификация актов правотворчества Президента Украины, определены направления для дальнейшего исследования темы. Обсуждение: необходимости изменения законодательства Украины относительно исследуемой сферы. |
